Diversion Program and Consent Calendar

  • Diversion is offered to youth who are viewed as unlikely to re-offend and whose current offense is of a level of severity that is viewed as appropriate for the diversion program. You can discuss whether diversion would be an option at the Preliminary Hearing.
    • There is no “official” adjudication but the youth agrees to participate in the program and complete all of the terms
    • There is a one-time $200 fee to participate in Diversion
    • Diversion usually lasts from 30 to 90 days
    • There is monthly supervision by a Juvenile Diversion Case Manager
    • Program requirements will be set at the time of entry into Diversion, and must be followed exactly by the youth and family
    • If the youth successfully completes the program, their record is destroyed within 28 days after their 17th birthday or 28 days after completion of the program as required by law
    • If the youth does not complete all of the requirements of the program successfully, the youth may be returned to Juvenile Court for prosecution, which may result in placement on probation and a juvenile record
    • All Court fees must be paid in full prior to closing
 
  • Consent Calendar is offered to youth who are viewed as unlikely to re-offend, but whose current offense is of a level of severity that is viewed as requiring an adjudication of responsibility.
    • The youth is placed on Consent Calendar monitoring for a limited time, with limited terms
    • There is a one-time $350 fee to participate in Consent Calendar
    • If the youth successfully completes the program, their charge is removed from the records within 28 days after their 17th birthday or 28 days after completion of the program as required by law
    • If the youth does not complete all of the requirements of the program successfully, the youth may be returned to Juvenile Court for prosecution, which may result in placement on probation and a juvenile record
    • All Court fees must be paid in full prior to closing
